PRELIMINARY ARTICLE — DEFINITIONS AND SCOPE

These Terms and Conditions of Sale (hereinafter the “T&Cs”) apply to all sales of SEABOB underwater scooters and official accessories made through the Seabob Shop e-commerce website operated by AQUA MARINE YACHTS MONACO.

For the purposes of these T&Cs:

  • “Seller” refers to AQUA MARINE YACHTS MONACO / Water Toys Center
  • “Website” refers to the Seabob Shop online store
  • “Products” refers exclusively to SEABOB units, accessories, batteries, spare parts, and related equipment
  • “Client” refers to any individual or legal entity placing an order on the Website

These T&Cs apply to both professional (B2B) and private (B2C) clients, unless otherwise expressly agreed in writing.

The applicable version of the T&Cs is the one published on the Website at the time of the order. By placing an order on the Website, the Client acknowledges having read and accepted these T&Cs in full and without reservation.

In case of conflict between different language versions, the English version shall prevail for international sales.

ARTICLE 2 — PURPOSE

These Terms and Conditions of Sale (T&Cs) govern the sale of SEABOB underwater scooters and their official accessories on the Seabob Shop website.

This includes, but is not limited to:

  • SEABOB underwater scooters (all series and models)
  • Official SEABOB accessories
  • Lithium-ion batteries and chargers
  • Spare parts and technical equipment
  • Nautical equipment related to the use of SEABOB products

The products offered are high-end motorized nautical equipment intended for marine use, in compliance with manufacturer recommendations and applicable regulations. This list is indicative and non-exhaustive.

ARTICLE 3 — PRODUCTS

Products are described as accurately as possible. Visuals, photographs, and renderings are non-contractual.

Products may include specific technical characteristics, including:

  • Lithium-ion batteries
  • Sensitive electronic components
  • Marine environment usage
  • Requirement for rigorous maintenance
  • Potentially hazardous use

The use of these products may require appropriate training or supervision.

ARTICLE 4 — PRICES

Prices are indicated in euros (€) and expressed excluding VAT (excl. tax), unless explicitly stated otherwise. Applicable VAT will be added in accordance with current legislation.

Additional fees may apply, including:

  • Transport
  • Transport insurance
  • Special packaging
  • Export formalities
  • Dangerous goods transport (lithium batteries)

For deliveries outside the European Union, customs duties, local taxes, import fees, and clearance charges are the sole responsibility of the client.

ARTICLE 5 — ORDERS

Any order implies full and unconditional acceptance of these T&Cs.

The Seller reserves the right to refuse or cancel any order in the event of:

  • Non-payment
  • Suspected fraud
  • Regulatory non-compliance (export, customs, restricted countries)
  • Exceptional product unavailability
  • Incomplete or inconsistent address
  • Any legitimate reason involving legal, regulatory, financial, or technical risk

ARTICLE 6 — PAYMENT

Payments may be made via:

  • Bank transfer
  • Secure payment link
  • Any other method accepted by the Seller

An order becomes final only after effective payment validation. Shipment of the products will only occur after full and irrevocable receipt of funds by the Seller.

ARTICLE 7 — DELIVERY

Products are delivered to the address provided by the client. Delivery conditions may be subject to a specific Incoterm agreed at the time of sale.

Transfer of risk occurs in accordance with the applicable Incoterm or, failing that, upon handover to the carrier.

The client must check the apparent condition of the package upon delivery. Any reservation must be clearly stated on the carrier’s document and confirmed in writing within 48 hours. Failing this, no claim regarding visible damage will be accepted.

Delivery times are provided for information purposes only. Reasonable delays shall not give rise to cancellation or compensation.

The client is responsible for proper storage conditions after delivery, particularly for batteries and electronic equipment.

ARTICLE 8 — LIABILITY

The products sold are motorized nautical equipment that may present risks.

The client acknowledges that they:

  • Are capable of using the product
  • Will comply with local maritime regulations
  • Will read and follow the manufacturer’s instructions
  • Will use the product under appropriate conditions

The client is solely responsible for the product’s compliance with regulations in the country of use.

The Seller shall not be held liable in cases of:

  • Misuse
  • Lack of maintenance
  • Product modification
  • Use not in accordance with recommendations
  • Negligence or imprudence
  • Any repair, maintenance, modification, or opening performed by a non-authorized third party

The Seller’s liability is strictly limited to the ex-VAT amount of the order concerned, excluding any indirect, immaterial, or loss-of-profit damages.

ARTICLE 9 — LITHIUM BATTERIES

Products may contain lithium-ion batteries classified as dangerous goods.

The client agrees to:

  • Strictly follow manufacturer instructions
  • Use only the supplied charger
  • Never leave a battery charging unattended
  • Not charge near flammable materials
  • Respect recommended charging cycles
  • Perform maintenance charging at least once per month if unused
  • Store batteries in a dry and temperate environment
  • Never open, dismantle, modify, or puncture the battery

Any overcharge, prolonged undercharge, improper storage, or non-compliant handling will void the warranty.

ARTICLE 10 — WARRANTY AND MISUSE

Products benefit from applicable legal warranties and the manufacturer’s warranty.

Misuse notably includes:

  • Insufficient or excessive immersion depth
  • Use in excessively sandy or muddy water
  • Failure to rinse with fresh water after saltwater use
  • Use by untrained persons
  • Exceeding manufacturer limits
  • Electronic or mechanical modification
  • Repair by a non-authorized third party
  • Undeclared intensive professional use
  • Failure to respect battery charging cycles

The warranty is excluded in cases of misuse.

ARTICLE 11 — RIGHT OF WITHDRAWAL (B2C)

In accordance with consumer law, private customers have a 14-day withdrawal period.

The right of withdrawal does not apply to:

  • Products that have been used in water
  • Products showing signs of immersion, humidity, or salt
  • Products whose internal electronic counters show usage
  • Batteries that have been activated or charged
  • Customized products

The right of withdrawal does not apply to professional clients. Return shipping costs are borne by the client.

ARTICLE 12 — AFTER-SALES SERVICE & RETURNS

Any return requires:

  • Prior written request
  • Seller’s authorization

Products must be returned in their original packaging and in strictly compliant condition.

ARTICLE 13 — FORCE MAJEURE

Force majeure events include, but are not limited to:

  • Port or customs blockage
  • Export authorization refusal
  • International conflicts
  • Supplier failure
  • Component shortages
  • Exceptional transport cost increases
  • Strikes
  • Natural disasters
  • Health or energy crises

No compensation may be claimed in the event of force majeure.

ARTICLE 14 — APPLICABLE LAW

These Terms and Conditions are governed by Monaco law. Any dispute shall be subject to the competent courts of the Seller’s registered office, unless mandatory provisions state otherwise.
